Terms of purchase (Pre-contractual notices)
I. General
The website www.almas.hr is owned by the trading company ALMAS HM d.o.o., Zagreb, Drenovačka ulica 7, ID: 43785939168.
All materials found on www.almas.hr website are the exclusive intellectual property of ALMAS HM d.o.o., they can only be used with the express permission of the copyright holder, and the holder of trademark and/or design rights. ALMAS HM d.o.o. enables the use of services and content of the website www.almas.hr as governed by these Terms of Purchase.
These Purchase Terms are part of the Seller's obligation in accordance with the provisions of the Consumer Protection Act, and serve to ensure that the Buyer, before entering into a distance contract, is informed in a clear and comprehensible manner about a series of circumstances that are essential for the conclusion, execution, termination of the contract, and all in accordance with the law.
The term Seller therefore refers to the trading company ALMAS HM d.o.o., Zagreb, Drenovačka ulica 7, OIB: 43785939168, MBS: 081377010, T: 00 385 1 2093 745, E: almas@almas.hr, W: www.almas.hr.
The term Customer also refers to: a classic consumer: a natural person who, outside of any activity, orders and pays for any product through the web shop services present on the Seller's website, but also to artisan buyers, individual traders and natural persons who perform business activities, and who are protected by the provisions of the Consumer Protection Act only if they buy products unrelated to their business activities, and to all other customers, for example legal entities.
By selling through the website www.almas.hr the seller acts on his own behalf.
The conditions of purchase form part of the contract concluded at a distance together with the specifications and price(s) of the purchased product(s), and before confirming the order for the purchase of an individual product, the Customer will be asked to accept/declare that he/she is familiar with/agree with them, while after confirmation order (conclusion of the contract) shall be delivered to the Customer as the content of the e-mail message confirming that the contract has been concluded. The seller reserves the right to change the conditions at any time, with the said changes coming into force after publication on these websites.
When the Buyer confirms and completes the order, the contract is concluded, and the Seller will immediately notify the fact of the conclusion of the contract by e-mail that the contract has been concluded.
For a validly concluded contract, it is necessary that the Buyer is a person with full business capacity.
The customer is responsible for the completeness and truthfulness of the data entered during registration.
The terms of purchase are divided into categories/information classified below.
Access to the website www.almas.hr it may sometimes be unavailable due to works, maintenance or the introduction of new content and in cases of unforeseen circumstances beyond the control of the Seller, which the Seller will try to eliminate as soon as possible.

II. Main characteristics of the goods
The main characteristics of the goods: the products are presented descriptively and with photos, and the information about them is compiled on the basis of the almas database.
Product photos are illustrative in nature, and do not always have to correspond in all details to the products that are the subject of the order. The seller especially points out that the visual identity of the product shown in the photo does not have to correspond to the appearance of the product in reality, especially considering the monitor settings on the customer's computer, differences in the perception of colors as the customer sees them on the screen, etc. In the case of the above discrepancy between the product shown in the photo and delivered product, it is not about a lack of product.
Product information (product description, price, etc.) displayed on the www.almas.hr website is subject to bugs, irregularities in the operation of the application, other technical irregularities, typographical errors, etc. In the event of obvious errors or malfunctions with regard to product information shown at www. almas.hr The seller reserves the right to terminate the contract unilaterally.
The subject of the order can only be products for which it is indicated in the order that they are available and available. Due to the large number of orders that are submitted at the same time on www.almas.hr, it may happen that the information about the availability of the product is not the same as the situation in the almas warehouse.
If the ordered product is not available in the warehouse, the Seller will inform the Customer that the product is currently unavailable, the time frame in which the product is available, and at the same time offer the possibility of purchasing an alternative product from www.almas.hr that is available for delivery and that is closest in terms of its characteristics product that cannot be delivered.
III. Product price
The prices displayed on the website www.almas.hr are expressed in euros (EUR). The cost of VAT is included in the price of the product. The product prices do not include delivery costs, for the reason that they are paid separately, except for orders above a certain amount when delivery is free, and all in accordance with the conditions and in the manner indicated in these Terms of Purchase.
Before confirming the order, the price of the product, the price of delivery if chargeable, the price of VAT, and the final price are shown separately so that the Customer has an overview of the final price he pays for the ordered purchase service.
In case of payment by e-banking and general money order, payment costs and/or interbank transactions are not included in the price.
IV. Shipping costs
They are announced when ordering for each individual product, as well as the total shipping costs in case of ordering several products.
The delivery price is divided into two classes:
order value up to EUR 150.00 – EUR 30.00
order value over EUR 150.00 - free delivery
Note: the stated delivery prices and benefits related to them are valid only for deliveries to the territory of EU.
Packages are packed diligently, and delivery strives to meet all expectations. Deliveries take up to 1-2 working days.
*We do not deliver goods on Saturdays, Sundays and holidays.
In case of impossibility of proper delivery to the address indicated by the Buyer due to the perishable nature of our product, we will not be able to refund the money for the product that was not received within two days of delivery due to incorrect or insufficient information provided by the buyer and/or the absence of the recipient.
V. Costs of using remote communication means
The seller does not have any additional costs for means of remote communication.
VI. Terms of payment, terms of delivery of goods, time of delivery of goods
Products are ordered by selecting, using the menu and filling out the electronic form. The customer can order and purchase the product as a registered or unregistered user. The product is considered ordered when the customer goes through the entire ordering process.
Payment for ordered products can be made in the following ways:

Card payment via the Internet (Maestro, MasterCard, Visa, Premium Visa, Diners, Discover)
In case of payment by online payment, virman, internet banking, you will receive an order confirmation with all the information necessary for payment to your email address. You can then make the payment using internet banking or the way you normally pay your bills - through the bank, post office, Fine or similar.
Upon receipt of payment, we will send you the ordered items.
In the case of payment by credit card, the payment must be made no later than the deadline indicated in the e-mail message confirming that the contract has been concluded.
In relation to payment by credit card, the Seller points out that the card payment system is integrated on the website. After selecting payment "Payment by credit/debit card", the fields for entering card information will open. Card and owner data are not stored on the seller's servers. Diners and Premium Visa cards can be used to pay in installments. It is necessary to select the number of installments, from two to six. The costs will be calculated according to the Customer's choice, and the card will be debited successively every month, according to the number of selected installments. The purchase was made after successful authorization of the card. If the system refuses to authorize the card payment, you must choose one of the alternative payment methods. The Seller has no data on the causes of card rejection, they may be of a technical or business nature.
If the customer does not receive notification that the contract has been concluded after the ordering process is completed, it is suggested to check:
In the event that the payment is not made within the stated deadline, the Seller will proceed with the subsequently made payment outside the deadline by delivering the purchased products, and if he cannot make the delivery for justified reasons, he will unilaterally terminate the contract and return the paid funds.
If the payment has been properly made and is visible on the Seller's account, the Seller will proceed with the delivery of the ordered products. The invoice for the order is delivered in the shipment together with the goods.
The ordered products are delivered to the entire territory of the Republic of Croatia.
We deliver personally through an Almas employee or an authorized delivery company. The cost of delivery is borne by Almas, unless otherwise stated.
The delivery will take place no later than 15 working days from the visible payment on the Seller's account. If it becomes impossible to deliver the selected product because the product is no longer available, the Seller is obliged to notify the Buyer immediately, and the Buyer has the right to terminate the contract and request a refund or agree to a later delivery date. The customer can expect a refund on his account within 3 working days. All ordered items will be delivered in one package. If this will not be possible due to the state of stock, the Seller reserves the right to deliver in multiple shipments.
The customer will be informed about the day of delivery and approximate delivery time by Almas employees.
Delivery is usually made between 08:00 and 16:00.
Delivery is carried out in accordance with the terms of use of the delivery service, and is considered completed at the moment of handing over the product to the delivery service.
In the event that delivery by delivery service is not possible for a particular place (within the Republic of Croatia), the customer will be informed in writing about the impossibility of delivery.
Unfortunately, the Seller is not able to influence the further speed of delivery and possible complications related to the delivery itself caused by the delivery service. For each shipment, the Buyer certifies and signs the delivery list upon receipt of the shipment.

If the product sent to the Customer is returned because the delivery service failed to deliver, the Customer will be notified by e-mail and we will not be able to refund the money due to the perishable nature of our product.
When the Seller delivers the product to the Buyer through the delivery service, the Buyer is obliged to take over by signing the delivery note, thereby confirming that the product has been properly delivered.
In the event that the Buyer orders goods and refuses to receive them, the Seller has the right to withhold the amount of the purchase price due to the perishable nature of our product.
The customer does not have the right to unilaterally terminate the contract if:
VIII. Complaints and returns
Our product is held to the highest standards of quality and freshness. Upon arrival, all products should be thoroughly inspected and all perishable goods should be immediately cooled.
If there is concern that the product received is unsatisfactory, a claim must be made within 24 hours of receipt of delivery. Upon notification, Almas will provide return authorization and specific return instructions.
Returns will not be accepted without prior return authorization.
We will not grant returns for a partially consumed product. Due to the perishable nature of our product, we will not be able to refund any product not received within two days of delivery due to incorrect or insufficient information provided by the customer and/or the absence of the recipient. Be sure to keep all packaging in case a return is required. Almas is not responsible for lost or stolen goods.

In our activity, we collect and process personal data of our customers and parties interested in our products, while respecting all relevant laws and regulations.

What type of personal data does Almas collect and process through the website www.almas.hr?
When registering a person as a Customer of the website www.almas.hr, Almas will ask the future Customer to provide certain information about himself (personal data), such as name and surname, address (including postal code), e-mail address, telephone number, date of birth (optional), username and password.
After the person registers as a Customer, Almas will request certain personal information from the Customer during registration: first and last name, address, city and postal code, phone number (optional), mobile phone number, date of birth and gender. The customer confirms that he agrees to the processing of personal data by clicking on the application button.
When registering a person as a User receiving information about products and opportunities on the www.almas.hr website, Almas will ask the future User to enter information about himself (personal data), namely: name (optional) and e-mail address.
The provision of personal data is the decision of the Customer or User. If the Customer or User does not provide the requested mandatory information for a certain activity that requires it, he will not be allowed to participate in such an activity, because without this information the activity will not be technically feasible.
In addition to this data, we automatically collect data from your computer, which may include an IP address, and there are also situations in which we automatically collect other types of data, such as the date and time of access to the www.almas.hr website, information about hardware, software or Internet the browser you use as well as your computer's operating system and application version and your language settings.
We may also collect information about clicks and pages that you have been shown. Almas recommends that Customers take care of their login password for the user account of the website www.almas.hr. We recommend that when choosing a combination of characters for the password, you should definitely combine upper and lower case letters and numbers, and that you should definitely use a password of at least six characters. For what purpose does Almas collect and process personal data?
Almas collects and processes the personal data of the Buyer of the website www.almas.hr for the purpose of conducting a secure authentication of Buyers who access the website www.almas.hr, realization of contracts for the purchase of goods or services, delivery of goods to the Buyer, communication with the Buyer, possible legal procedures related to the implementation of the contract, and partly we also apply automated processing processes in order to constantly improve our processes in the interest of the Customers, to make the offer for the Customer more individual and to adapt our offer of products and services as much as possible to the habits and needs of the Customers. Almas collects and processes personal data of Customers registered in the Customer profile of the website www.almas.hr for the purpose of creating personalized content through automated data processing processes.
Almas collects and processes the personal data of the User receiving notifications about products and opportunities for the purpose of sending notifications, invitations to participate in prize competitions via e-mail, social networks or other communication channels to which the Customer has previously registered, possible legal procedures related to the implementation of the contract , in order to create a user profile with the aim of receiving individual notifications, market research and improving the efficiency and quality of our services.
Almas does not collect information about children. If we become convinced that such information has been transmitted to us without the consent of the parents or guardians of children under 16 years of age, we will remove it without delay. Minors under the age of 16 may not use the website www.almas.hr. No part of the www.almas.hr website is designed to attract anyone under the age of 16.
What is the legal basis for processing personal data?
By entering his personal data and by confirming (clicking) his acceptance of the General Business Terms and this Privacy Policy and the terms of use of personal data, the customer enters into a contractual relationship that is the basis for the purchase of products and services of the customer's choice on the website www.almas.hr which is contained in the Terms of Purchase (pre-contractual notices) and therefore the processing of such personal data is legal because actions are taken at the Customer's request in order to realize the purchase of products and services ordered by the Customer.
The user who registers to receive information about products and opportunities by entering his data on the website www.almas.hr and double confirming the correctness of his email address, gives his consent to the processing of his personal data. The User can withdraw the consent at any time by sending a notification to the personal data protection officer's email address almas@almas.hr.

The distribution service provider may ask the Customer for his/her identity card at the time of delivery of the package during the personal collection of the goods, all for the purpose of realizing the package delivery service and keeping records of who collected the package. If the Customer refuses to provide this information, the package will not be delivered.
Processing of personal data in the process of payment by credit and debit cards
At the time of payment on the website www.almas.hr, as a condition for paying for products and services by credit or debit card, Almas requests the Customer's consent to activate the payment process via Web studio d.o.o. (WSPay), Rijeka, Ćićarijska 10, service provider of processing and billing (credit or debit) cards, contractual partner of Almas and Executor of personal data processing. For this purpose, the Customer's personal data (Customer's first and last name, Customer's address, data from the Customer's card) are temporarily stored at Web studio d.o.o. At no time does Almas dispose of, collect or process personal data entered for the purpose of card processing and billing. Customers are instructed to inform themselves about the processing of personal data by Web studio d.o.o. (WSPay) the website where the payment process takes place. Personal data stored at Web studio d.o.o. (WSPay) are deleted immediately after the card processing and billing process.
Period in which personal data will be stored
Almas stores the personal data of registered Customers of the website www.almas.hr for the period while the purpose of the processing is achieved, which is the period until the moment when the registration is active and six months after the end of the Customer's registration, during which period any complaints from the previous period will be resolved . Almas stores the personal data of registered Users receiving notifications about products and opportunities for the period while the purpose of the processing is achieved, which is the period until the moment when the registration is active.
Access and correction of personal data
The Customer and the User have the possibility to access their personal data at any time by registering on the site and by accessing "my account" where the Customer can revise their personal data that they have shared on the www.almas.hr page. The Customer and User can request and receive from Almas complete information about the personal data that is stored, as well as the correction of the same, by sending an e-mail message to the e-mail address of the personal data protection officer: almas@almas.hr.
Deletion of personal data (right to be forgotten)
The customer and user have the right to request deletion of personal data at any time (right to be forgotten). The customer can do this by sending a request to the email address of the personal data protection officer almas@almas.hr and the data will be deleted within thirty days. Data about purchases via the web shop remain stored in the account for the purchase in question in accordance with other legal obligations. The user has the option of submitting a request for deletion in every notification he receives from Almas via e-mail, that is, he can send an e-mail message to the e-mail address of the personal data protection officer almas@almas.com.hr stating that his personal data should be deleted.

The collected data is in electronic form and protected by an SSL certificate that encrypts the data and thus ensures that the communication between the Customer's or User's computer and the website www.almas.hr takes place using a secure protocol. Almas takes data protection seriously and takes various precautions to protect personal data. Unfortunately, no data transmission over the Internet, or any wireless network, can be 100% secure. As a result, although Almas implements reasonable data protection measures, it cannot guarantee the protection of any information transmitted to or from the website www.almas.hr and is not responsible for the actions of any third party that receives such information.
